PRIVACY POLICY AND DATA PROTECTION

This document is an integral part of the GENERAL TERMS AND CONDITIONS OF USE AND CONTRACTING. By using the TECOPAS Mobile Application (hereinafter, "the App"), as well as contracting services through it, you accept the policies contained herein. Respecting the provisions of Law 25.326 and other applicable legislation, TECOPAS LLC, residing at 16192 Coastal Hwy, Lewes, DE 19958, US.

(hereinafter, "the Company"), is committed to adopting the necessary technical and organizational measures, according to the appropriate security level for the risk of the collected data.

1. Personal Data

We inform you that by using the App and contracting the services, you acknowledge and accept that:

a) The Company will have access to certain personal data of yours, which is indispensable for the Company to provide its services. Likewise, the Company is expressly and irrevocably authorized by you to store and use your data to provide you with information, offer you services, personalize the content included on the Website and/or the App according to your preferences, conduct advertising, and/or use the data in an anonymized form. By accepting these Terms and Conditions, you provide your express consent for the collection, use, and processing of your data by the Company as stipulated herein.

b) You expressly provide your free, informed, and express consent as provided by Law 25.326 for the processing of your data and for the possibility of its transfer for the provision of the contracted services, and/or for other purposes indicated herein, which may be revoked by you at any time by requesting it through the forms and means the Company makes available for such purposes.

c) You are solely and exclusively responsible for the information you provide and its truthfulness, accuracy, completeness, and consistency, and you will indemnify the Company, its directors, officers, and shareholders for the consequences of any third-party claims related to or arising from the provision of personal information, including but not limited to direct, indirect, immediate, and consequential damages.

d) No data processing can be completely secure and may be subject to interception and/or use by third parties. You assume this risk and acknowledge and accept that the Company cannot ensure the security of such data.

2. Email

You authorize the Company to send you emails regarding the App's content and/or services or about your account and in response to your questions, requests, inquiries, or comments. The Company may also send you emails with information about the Company and/or commercially associated third parties that may be of interest to you, although you may expressly indicate that you do not wish to receive such emails through the processes implemented by the Company for this purpose.

3. Purposes of Personal Data Processing

Personal data is collected and managed by the Company to facilitate, streamline, and fulfill the commitments established between the Company and you, or to maintain the relationship established in the forms you fill out, or to respond to a request or inquiry. Additionally, the data may be used for personalization, operational, and statistical purposes, and activities related to the Company's social purpose, as well as for data extraction, storage, and marketing studies to tailor the content offered to you and improve the quality, functionality, and navigation of the Website and/or App.

4. Retention Periods for Personal Data

Personal data will only be retained for the minimum time necessary for the purposes of its processing and, in any case, only for the following period from when your account is deactivated: 2 years.

5. Confidentiality and Security of Personal Data

The Company is committed to adopting the necessary technical and organizational measures, according to the appropriate security level for the risk of the collected data, to ensure that, within its scope, personal data is secure and to prevent, as much as possible, accidental or illegal destruction, loss, or alteration of transmitted, stored, or otherwise processed personal data, or unauthorized communication or access to such data.

Since the Company cannot guarantee the invulnerability of the internet or the total absence of hackers or others who may fraudulently access personal data, the Company undertakes to notify you without undue delay if a breach of personal data security occurs, which is likely to result in a high risk to the rights and freedoms of individuals. A personal data breach is understood to be any breach that leads to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access to transmitted, stored, or otherwise processed personal data.

Personal data will be treated as confidential by the Company, which undertakes to inform and ensure, through legal or contractual obligations, that such confidentiality is respected by its employees, associates, and any person to whom it makes the information accessible.


6. Rights Derived from Personal Data Processing

You may exercise the following rights:

  • Right of access: The right of the User to obtain confirmation of whether the Company is processing their personal data and, if so, to obtain information about their specific personal data and the processing that the Company has carried out or is carrying out, as well as, among other things, the available information about the origin of such data.

  • Right of rectification: The right of the User to have their personal data corrected if it is inaccurate or, taking into account the purposes of the processing, incomplete.

  • Right of erasure ("the right to be forgotten"): The right of the User, as long as the applicable legislation does not state otherwise, to obtain the deletion of their personal data when it is no longer necessary for the purposes for which it was collected or processed, to withdraw their consent to processing if there is no other legal basis for it, to object to processing if there is no other legitimate reason to continue it.

You can exercise your rights by sending a written communication to the Company, specifying:

  • Name, surname, and a copy of your ID. In cases where representation is permitted, the representative's identification by the same means is also required, as well as the document proving the representation.

  • A request with the specific reasons for the request or the information you wish to access.

  • Address for notification purposes.

  • Date and signature of the requester.

  • Any document that proves the request being made.

7. Links to Third-Party Websites

The App may include hyperlinks or links that allow access to websites of third parties that are not operated by the Company. The owners of such websites will have their own data protection policies and will be responsible for their own files and privacy practices.

8. Complaints to the Supervisory Authority

If you believe that there is a problem or a violation of current regulations regarding the way your personal data is being processed, you have the right to effective judicial protection and to file a complaint with a supervisory authority, in particular, the National Directorate for Personal Data Protection. https://www.argentina.gob.ar/aaip/datospersonales

9. Collaboration with Public Authorities

The Company may disclose your Personal Information at the request of competent judicial or governmental authorities for investigations conducted by them, even if there is no executive or judicial order or subpoena, or for example (and without limiting this case) in the case of criminal or fraud investigations or those related to computer hacking or copyright infringement.

The Company reserves the right to modify its Privacy Policy, at its sole discretion, or motivated by a legislative or jurisprudential change regarding Data Protection. Changes or updates to this Privacy Policy will be explicitly notified to you by email to the address provided during registration.
